Mortgage Terms of Business

HD Rhodes is not an appointed agent of any lender for mortgage business, and therefore is able to arrange mortgages from the whole market place. HD Rhodes subscribes to the Mortgage Code.

The Mortgage Code came into effect for intermediaries on 30th April 1998 and is a voluntary Code to which HD Rhodes adheres to and subscribes. The Code sets minimum standards of good lending and advisory practice, which are to be followed by all lenders and mortgage intermediaries.

HD Rhodes is registered with the Mortgage Code Compliance Board under registration number 5552966.

Please note, the Mortgage Code only applies to residential mortgages, and as such you have no redress under the Code for any Buy to Let or commercial arrangements.

We constantly review the mortgage market in order to select appropriate lenders to meet your individual circumstances. We use lenders who consistently provide our customers with a competitive product range and high standards of service.

Under the terms of the Code, there are three levels of service available. These are:
· Full advice and recommendation.
· Information on different types of mortgage products available to allow you to make a choice.
· Information on a single product only, where no advice is given.
We offer a full advice and recommendation service in all cases, in order that you can make an informed decision about the choice of your new mortgage.

We will also provide you with information relevant to your mortgage needs, covering such items as an explanation of the main repayment methods and the implications of taking out a mortgage.

During our initial meeting, we will complete a detailed mortgage/financial review questionnaire to enable appropriate advice to be given on your mortgage and other related insurance products.

We require our clients to give us instructions in writing to avoid possible disputes. If the matter is urgent we will accept oral instructions provided they are confirmed in writing.

You, or we, may terminate our authority to act on your behalf at any time without penalty. Notice of this termination must be given in writing.

Once we have made our recommendations to you, we will confirm our advice in writing. You should retain this confirmation as a record of the advice given. Details of any product recommended will be confirmed by the lender on a formal Offer of Advance.

Before completing the mortgage application, your adviser will inform you if HD Rhodes will receive a fee for arranging your mortgage. This amount will be confirmed in writing prior to completion.

We never accept a cheque made out to this company (unless it is a cheque in settlement of fees or disbursements) or handle cash.

We will forward documents to you as soon as practicable after we receive them. Where a number of documents relating to a series of transactions is involved we will normally hold the documents until the series is complete and then forward them to you.

We keep records of all our business transactions for seven years. You (or your agent) may inspect contract notes, vouchers and entries in books (whether kept manually or electronically). We treat all our clients' records as confidential, so we reserve the right to give you copies of your particular records rather than allowing access to files containing records about other clients. You have a right of access under the Data Protection Act 1998 to your personal records.

As your mortgage broker, we reserve the right to discuss your personal circumstances with any lender, in order to determine the most appropriate product for your needs. Your lender may undertake credit enquiries upon receipt of your mortgage application. They may also supply information to a Credit Reference Agency regarding the way your account is managed.

Your Protection, in the unlikely event of you ever having any complaint about the advice you have received or a product which we have arranged on your behalf, please immediately contact our Mortgage Code Compliance Officer, Mr David Rhodes, 134 Yorkshire Street, Rochdale. OL16 1LD Telephone 01706 860180 . He will make every effort to resolve the problem and will explain your statutory rights. As mentioned previously, The Mortgage Code Arbitration Scheme does not cover Buy to Let or Commercial Mortgages.

Our internal auditing procedures will include monitoring and compliance of the Code. The Code is monitored by the Mortgage Code Compliance Board. Their address is available on request from our office. Complaints concerning the general operation of the Code can be made to them.

We maintain Professional Indemnity Insurance.
